NOTICE OF JOINT PUBLIC HEARING


BEFORE THE NORTHAMPTON COUNTY BOARD OF SUPERVISORS, THE TOWN COUNCILS OF THE INCORPORATED TOWNS OF CAPE CHARLES, CHERITON, NASSAWADOX AND EXMORE AND THE EASTERN SHORE OF VIRGINIA PUBLIC SERVICE AUTHORITY

PLEASE TAKE NOTICE, that the above-captioned public bodies will conduct a joint public hearing on June 28, 2010, at 7:00 p.m. in the auditorium of the former Northampton County Middle School, located at 7247 Young Street, Machipongo, Virginia, to consider the applications of the incorporated Towns of Cape Charles, Cheriton, Nassawadox and Exmore to become members of the Eastern Shore of Virginia Public Service Authority (“the Authority”) and to amend the Articles of Incorporation of the Authority to provide that the number of members of the Authority’s Board of Directors be increased from five (5) to ten(10) and for the powers of the Authority shall be exercised by ten (10) Authority Board members, all of whom shall be appointed in the following manner: One (1) Authority Board member shall be appointed by each of the four (4) member towns (Towns of Cape Charles, Cheriton, Nassawadox and Exmore), and six (6) At-Large Authority Board members shall be appointed by the Northampton County Board of Supervisors, which appointees may or may not be members of the respective governing bodies.

A copy of the resolution of the Authority and the proposed ordinance of the County and of each Town may be obtained at the temporary offices of the County, located at the former Northampton County Middle School, located at 7247 Young Street, Machipongo, Virginia and at the Town Offices of the Towns of Cape Charles, Cheriton, Nassawadox and Exmore.

Part I – Where is the ground water and how much is there?
With an overview of Accomack and Northampton County’s Water Supply Plans

The Eastern Shore of Virginia Ground Water Committee invites you to the first in a series of public workshops aimed at providing specific information on the Shore’s ground water resource used in each of our lives daily. This presentation will explain exactly where our ground water is located and detail how much is available. Britt McMillan, Consulting Hydrologist to the Ground Water Committee of Malcolm Pirnie, Inc. will be presenting.  Britt has consulted the Ground Water Committee for over a decade and has a broad understanding of the Shore’s ground water resource. His enthusiastic presentation covers the following:

  1. A review of the theory behind groundwater flow.
  2. The Water Balance – where does the water come from, how does it get there, and where does it go?
  3. How and where water is used on the Shore and effects on the resource?
  4. What limits our use of ground water?
  5. Water Supply Planning – what is being done to manage our ground water resource?

 

The seminar will be held at the Shore Bank Financial HQ Building, 25020 Shore Parkway, Onley, Virginia, on Wednesday, June 9th, from 6:30 to 8:00 p.m.  Refreshments will be served.

NOTICE OF PUBLIC HEARING

The Northampton County Board of Supervisors will conduct a public hearing on Tuesday, June 8, 2010, in the former Northampton Middle School auditorium, 7247 Young Street, Machipongo, Virginia, at approximately 7:00 p.m., for the purpose of receiving the views within the Northampton County School District regarding the appointment of one District One Member and one At-Large Member of the Northampton County School Board.

Those interested in being considered for appointment to the School Board should file an application for same in the office of the County Administrator.

Prior to May 13, 2010, the County Administrator’s Office is located at 16404 Courthouse Road, Eastville, Virginia. As of May 19, 2010, the County Administrator’s Office will be located at 7247 Young Street, Machipongo, Virginia.

Applications may be obtained from that office during regular business hours and should be returned to that office no later than 5:00 p.m., Tuesday, June 1, 2010. Additional information regarding this appointment may be obtained by calling the County Administrator’s Office at 757/678-0440.

PUBLIC NOTICE

On behalf of the Towns of Cape Charles, Cheriton, Nassawadox and Exmore, and on its own behalf, the County of Northampton is seeking interested persons for possible appointment to the Eastern Shore of Virginia Public Service Authority. Each locality will be responsible for selecting its own appointment(s). Skill sets being sought for potential PSA members include the following areas: financial, engineering, management, grant administration, legal, marketing/PR, and utilities. Additional job requirements include significant time investment, belief in the core mission of the PSA, and commitment to the project. Please provide resume and board bank application to the County Administrator's Office, P. O. Box 66, Eastville, Virginia, not later than Monday, May 10, 2010. The Eastern Shore of Virginia Ground Water Committee is holding the 7th Annual
EASTERN SHORE OF VIRGINIA
HOUSEHOLD HAZARDOUS WASTE COLLECTION

in conjunction with the 3rd Annual Mother Earth Day Festival
SATURDAY, May 8, 2010
10:00 AM – 2:00 PM

At parking lot on Main Street at the old bridge

Eastern Shore residents will have the opportunity to dispose of household hazardous waste.

Items to be collected include leftover garden chemicals, poisons, repellants, degreasers, fuels (gasoline and kerosene) fungicides, wood preservatives, paint products, wood stain, paint thinner, paint remover, driveway sealers, epoxy, rodent poison, asbestos, and other hazardous waste.

No commercial or industrial waste, car batteries, tires, motor oil, ammunition, flares, explosives, medical waste, biological waste, radioactive waste, medicines, PCBs, smoke detectors, freon, propane tanks, or empty containers of any kind will be accepted.

Reusable paint will be collected and donated to the Eastern Shore Food Bank.

Participants can dispose of up to 30 pounds of hazardous waste for free. Additional hazardous waste will cost $1.00 per pound. Disposal of the first 30 pounds for free will be available only as funds allow, so arrive early to ensure your spot!

Public Notice


The Northampton County Planning Commission will meet on Tuesday, April 6, 2010, at 7:00 p.m. in the former circuit courtroom located at 16404 Courthouse Road in Eastville, Va. The purpose of the meeting is to conduct regular business and public hearings on the following matters.

A. Special Use Permit 10-04: Bobette Price has applied to locate an accessory living unit on property owned by Robert L. Lewis located at 5105 Plantation Drive (SR 643). The property, zoned A/RB Agriculture/Rural Business District, is described as being Tax Map 92, double circle 1, parcel 3A.

B. Zoning Text Amendment 10-03: The Northampton County Planning Commission proposes to amend the Northampton County Code §154.003 (C) Specific Definitions by amending the definitions of ACCESSORY LIVING UNIT, ARTISAN STUDIO, ARTIST STUDIO, DESIGN STUDIO, and DWELLING UNIT. The Planning Commission also proposes to amend Chapter 154 Appendix A-Use Regulations, Category 3-Commercial Uses in the Northampton County Code to revise the references to “Art Studio” to read “Artist Studio” and to allow DESIGN STUDIO with a Minor Special Use Permit in the Waterfront Village-Neighborhood Business District.

C. Zoning Text Amendment 10-04: The Northampton County Planning Commission proposes to amend Northampton County Code §154.249 PROVISIONS FOR SPECIAL USES by inserting the following language: “Single-section or multi-section manufactured homes that comply with the current HUD manufactured housing code are exempt from the requirements of this Section in accordance with §154.246 (D) (2) provided that the degree of nonconformity is not increased.” Both sections referenced are under the general category of Nonconforming Uses & Vested Rights Policy.

The Board of Supervisors shall also conduct public hearings on the above matters on Tuesday, April 13, 2010 at 7:00 p.m. in the former circuit courtroom located at 16404 Courthouse Road in Eastville, Va. The applications will be on file and open to public inspection in the office of the Clerk of the Board of Supervisors and in the Department of Planning & Zoning located at 16404 Courthouse Road, Eastville, Va.

Public Notice


This notice is to advise that two Agriculture and Forestal Districts (AFD) are now scheduled for the ten-year review before the Northampton County Board of Supervisors. The Board has also received AFD applications to add acreage to existing Agricultural and Forestal Districts and referred same to the Northampton County Local Agriculture-Forestal Advisory Committee and the Northampton County Planning Commission.

Two applications have been filed for additions to the following existing districts: Mason Farm AFD and Happy Union AFD.

The addition to Mason Farm AFD has been filed by The Judith F. Burger Trust Dated January 8, 2008 to add 52.86 acres of land located on Nassawadox Creek and Cedar Cottage Road and is described as Tax Map 20, double circle 3, parcel A.

The addition to Happy Union AFD has been filed by A. Stephen Boyer to add 74 acres of land located on Nassawadox Creek near the terminus of Wellington Neck Road (SR 609) and described as being Tax Map 14, double circle 13, parcel H.

Any owner of additional qualifying land may apply to join those applications as listed above within thirty (30) days from the date of this notice or, with the consent of the Board of Supervisors, at any time before the public hearing that the Board must hold on the applications.

The two AFDs known as Bridgetown and Happy Union are scheduled for review whereby the Board of Supervisors may decide to continue, modify or terminate a district. Bridgetown AFD is located along Cedar Farm Road (SR 695) extending along certain portions of the north and south sides of Bayside Road (SR 618) to a portion of the west side of Johnsontown Road (SR 618). Happy Union is located along the north and south sides of Happy Union Drive (SR 692) with additional acreage located across Nassawadox Creek along Johnson Point Land and Creek Court.

All applications along with any proposed modifications will be submitted to the Local AFD Advisory Committee and upon receipt of the committee’s report the Northampton County Planning Commission will hold public hearings on the applications and any modifications. After receiving the report of the Advisory Committee and recommendations of the Planning Commission, the Board of Supervisors will then conduct its public hearings and render decisions on each application as listed above.

The applications are on file and open to public inspection in the office of the Clerk of the Board of Supervisors located at 16404 Courthouse Road, Eastville, Va. Where applicable any political subdivision whose territory encompasses or is part of the district may propose a modification which must be filed with the Planning Commission in care of the Dept. of Planning & Zoning within thirty days of the date of this notice. Any owner who joined in the above applications may withdraw his/her land, in whole or in part, by written notice filed with the local governing body, at any time before the Board of Supervisors acts pursuant to §15.2-4309. Additional qualifying lands may be added to an already created district upon separate application pursuant to §15.2-4310 of the Code of Virginia.

PUBLIC NOTICE

The Northampton County Board of Zoning Appeals will meet on Tuesday, February 2, 2010, at 10:30 a.m. in the former Circuit Courtroom located at 16404 Courthouse Road in Eastville, Va., for the purpose of conducting regular business and public hearings on the following matters. At 9:00 a.m. Board members will assemble at the Dept. of Planning & Zoning in Eastville then travel to each property in order to conduct the necessary field visits.

1. Variance 09-09: Granville Hogg has petitioned for variances of 20-feet from the required 60-foot front yard building setback from Wilkins Drive, of 25-feet from the required 60-foot front yard building setback from Townfield Drive and of 15-feet from the required 25-foot rear yard building setback for the purpose of constructing a shelter. The property is located on the north side of Townfield Drive at the intersection of Wilkins Drive in the Cherrystone area and is zoned A Agriculture. The property is described as Tax Map 83, double circle A, parcel 28D.

2. Variance 09-10: WPKD LLC has petitioned for variances of a maximum of 54 feet from the required 100-foot front yard building setback from US Route 13, of 72 feet from the required 100-foot front yard building setback from an access road and of a maximum of 50 feet from the required 75-foot rear yard building setback for the purpose of commercial building. The property is located on the west side of US Route 13 south of its intersection with Stone Road (S. R. 184) and is zoned TE-CG Town Edge-Commercial General. The property is described as Tax Map 91A, double circle 2, parcel 5.

Furlough Dates Include:

Friday, October 9, 2009
Monday, December 28, 2009

Additional furlough dates will be imposed throughout the year for selected staff, and will be advertised. These additional dates will not result in the closure of the county offices

PUBLIC NOTICE

In an effort to reduce costs, the Northampton County Board of Supervisors has reduced the operating hours of the County’s Waste Collection Centers, to be effective Sunday, November 1, 2009. New Operating Hours are :

Monday—Saturday: 7:30 a.m. to 12 noon and 2:00 p.m. to 6 p.m.
Sunday: 2:00 p.m. to 6:00 p.m.

The County’s Sanitary Landfill will also implement its Winter Hours’ schedule effective November 1, 2009 through February 28, 2010.

Monday - Friday: 8:00 a.m. to 3:30 p.m.
Saturday: 8:00 a.m. to 12:00 noon
